Situation in Kashmir

1) The Security Council of the United Nations acting under Chapter VII of the Charter,
2) Recalling previous relevant resolutions, including S/RES/307 (1971) on
3) the necessity for a durable cease-fire in the troubled region of
4) Kashmir, and
5) S/RES/1172 (1998) on the dangers of nuclear-proliferation to
6) international peace, particularly in relation to the immediate South
7) Asian region, and
8) Aware that the present situation in Kashmir is dangerously and
9) undesirably close to open conflict, and
10) Noting that the present situation has arisen as a direct or indirect
11) result of the 13th December terrorist attack against the Parliament of
12) India, but
13) Reaffirming the need for India and Pakistan to pursue diplomatic
14) solutions to the issue, and
15) Mindful of the necessity for both India and Pakistan to co-operate
16) both logistically and politically to bring the perpetrators of the 13th
17) December attack to justice, and
18) Fully supportive of the efforts made by Pakistan in arresting over 12
19) activists of the Jaish-e-Mohammad organisation in the southern
20) province of Sindh, but
21) Noting that the Indian Government has failed to produce any concrete
22) evidence to the international community to establish that the 13th
23) December attacks were conducted by militants operating from Pakistan,
24) and
25) Also noting that the context of the situation is based on the
26) proclaimed "International War on Terrorism", but
27) Reaffirming that such an endeavour must be based on the principles of
28) international co-operation and coalition, and
29) Noting with regret that both Indian and Pakistani forces have unilaterally initiated
30) hostilities to the detriment of international peace and security and the purposes and
31) principles of the United Nations, and
32) Further noting that militarisation of the Kashmir region by either
33) side will not present a desirable solution that will solve the problem
34) of cross-border terrorism whether proven or otherwise, and
35) Aware that more than 15 are already dead since the buildup of military
36) activity on the Kashmir border, a figure which is already an
37) unnacceptable level of loss of life:
38) 1. Demands the immediate cessation of hostilities between India and
39) Pakistan along the Kashmir line of control; and
40) 2. Demands the immediate withdrawal of the military forces of both
41) India and Pakistan that have been mobilised in the region; and
42) 3. Reminds India and Pakistan of the perils to international peace and security a continued
43) escalation of the conflict would entail; and
44) 4. Calls on both sides to refrain from further escalation of the conflict in the Kashmir
45) region, and submit to diplomatic discussion to resolve the issue of cross-border
46) terrorism and issue of Kashmir; and
47) 5. Calls on the Indian Government to present concrete evidence linking
48) the 13th December attacks to terrorist elements in Pakistan to both
49) the government of Pakistan, and to this Security Council; and thereby
50) 6. Demands that the Government of Pakistan take action in response to
51) any evidence presented linking militants in Pakistan to any terrorist
52) activities by arresting those responsible and bringing them to justice
53) according to international laws on cross-border terrorism; and
54) 7. Reserves the right to implement all measures at its disposal under Chapter VII
55) to bring both sides to a termination of hostilities; and
56) 8. Remains actively seized of the matter.
